As Milan and Italy continue to attract travelers from all over the world, it's important to note the laws and customs that may differ from other countries. A recent legal battle between a luxury hotel in Alto Adige and one of its guests has shed light on the issue of tap water in restaurants.
The case, reported by Corriere dell'Alto Adige (Corriere della Sera), involved a tourist who stayed at the 5-star Sassongher hotel in Corvara in Badia over Christmas 2019. Despite spending 5700 euros on a week-long stay with half-board and drinks not included, the guest was denied tap water at the hotel's restaurant. The only option available was bottled water, priced at 7 euros for a 0.75 liter bottle. Unsatisfied with this, the guest took the matter to court, but was ultimately rejected by all levels of the Italian judicial system, including the Court of Cassation.
The guest argued that tap water is a natural resource and a universal human right, and that it should be freely provided as part of the restaurant's service. She also compared it to other amenities, such as a warm room and soap in the bathroom, that are expected to be included in a hotel stay.
However, the court ruled in favor of the hotel, stating that tap water is not a mandatory part of the restaurant's service and that the guest's request for compensation of 2700 euros for “economic or emotional distress” was also denied.
This case highlights the importance of understanding cultural and legal differences when traveling to a new country. In Italy, it is common for restaurants to only offer bottled water and for customers to pay for it. While it is acceptable to ask for tap water, it is ultimately up to the discretion of the restaurant to provide it or not. The same is true for charging a fee; you may ask for tap water, but the establishment has the right to charge a fee (for cleaning and service). As a traveler, it's important to be aware of these nuances and adapt accordingly.
